Please read this document carefully - by using our website and / or ordering goods from us on the telephone or in person you are agreeing to be legally bound by these terms and conditions.
Holosfoods is a trading name of BBS Services Limited, a company Registered in England, having it’s offices at Glebe Cottage, Upper Rissington, Gloucestershire GL54 2NX, being the operator of this website and being referred to in this document both by name and as “We” “Us” and “Our”. Where the terms “you” / “your” are used these refer to any person, persons or organization accessing or using this website and / or entering into a contract with us.
By using this website you agree to be bound by these terms and conditions, which may be subject to change without notice. You should visit this page from time to time in order to ensure you are aware of any changes.
All contracts to which these terms and conditions apply will be deemed as being entered into in Cheltenham, Gloucestershire and in the event of any dispute arising all parties agree that any such dispute should be resolved in accordance with the laws of the United Kingdom.
All information shown on this website, including, but not limited to product information, pricing, dietary flags, photographs, pack sizes, ingredients, nutritional information, product pricing and shipping costs is provided for illustrative purposes only. We take great care to maintain this information, and publish it in the belief that it is accurate and correct, however accurancy and correctness cannot always be guaranteed. By using the website you agree you indemnify us from any liability arising from any inaccuracies, errors, or omissions in / from this information. Particularly in respect of allergies we would firmly advise you to validate all information provided before using it as the basis for any action or inaction.
We aim to deliver 100% customer satisfaction in all areas of our business. If for any reason you are not entirely happy with our service or with any goods which you receive from us then please let us know at the earliest possible opportunity and, at our discretion, we will take whatever steps are reasonably and economically practical to address your concerns. Any goods which we agree you may return to us must be unopened and appropriately stored / packed by you.
By completing our registration and / or placing an order you confirm that you are 18 years old or over and are of sound mind. In cases where any laws or restrictions apply to any transactions which occur in relation to any purchase from our website you agree to ensure that these laws or restrictions are not breached as a result of the your actions or inactions.
Upon receipt of your order we will seek authorization from our third party payment processing partners as per your chosen payment method, and we will send you an email confirming the contents of your order and informing you whether your payment has been successful. When you place your order our website will display an “expected shipping date”. On, or within 24 hours of the “expected shipping date” we will provide a “despatch notification” by email, or by telephone, stating whether we have prepared your goods as ordered for despatch. At this point the contract of purchase is entered into. We will then supply the goods to you in accordance with this despatch notification, via your chosen delivery method.
In the event that we are unable to supply goods as ordered in full, or at all, we will notify you within 24 hours of the “expected shipping date” stated on our website when you placed your order, and prior to dispatching any other items you may have ordered. At this point we will send you a “notification email” and offer you the choice of a full or partial refund as per your preference. In the event of us not receiving a response from you within 48 hours of this notification email being sent then we will supply those goods which were ordered and are available, and issue a refund in respect of those that are unavailable. You agree to be bound by such adjustments to your order in the event that you are not able to respond to this email for whatever reason. In this scenario the contract of purchase is entered into either upon receipt of your response, or after 48 hours of the “notification email” being sent, whichever occurs first.
We will take reasonable care to ensure that all goods dispatched are appropriately packaged to avoid any possible damage in transit between from us to you. Goods are sold “Ex Works”, and in the event that your goods do not arrive, or arrive with you in an unsatisfactory condition then we may not always be able to offer you a full refund or replacement of these goods. You agree to indemnify us against any liabilities arising in the event that any loss or damage occurs through non delivery of the goods, or through delivery in an unsatisfactory condition.
Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizen's Advice Bureau.
We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.
Our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
We are not able to guarantee that any product or content on this website is appropriate, available, or legal for use in locations outside the UK. Accessing this website from territories where it’s content is illegal or unlawful is prohibited. Customer’s choosing to access this website from outside the UK you do so at the own risk, are responsible for compliance with local laws and import duties or taxes, and indemnify us against any such liabilities which may arise.
In accordance with the Data Protection Act we must inform you that we hold a record of all the details you provide to us as is required in order to provide our service to you. For further details of what information we hold, and how it is used please read our Privacy Policy.
Returns, Refunds & Cancellations
In the even that you are unhappy with your order due to material defect, misdescription or damage to the items you receive, please inform us within 72 hours of receipt (contact details can be found at the bottom of this page). Particularly in the event of damage it may be helpful if you are able to provide one or two photographs of the goods as they arrived with you.
Upon receipt of your claim we will instruct you as to whether the goods may be disposed of, or in some cases we may ask you to arrange return carriage to us.
Upon validation of your claim, and, where appropriate, following return of the damaged or defective goods we will issue you with a refund proportionate to the purchase price paid, and the quantity of goods which were damaged or defective, plus a proportion of the postage cost.
In the event that you change your mind about your purchase after we have despatched your order, we will happily accept return of goods in resaleable condition for a period of 28 days after completion of your order. In order to quantify it is important that returned products are unopened. Before returning any items please contact us (using the details at the bottom of this page) to obtain written authorisation and instructions for return.
Upon receipt of the returned items in satisfactory condition we will issue a refund proportionate to the quantity of goods returned and the purchase price paid. Note that in this situation we are not able to refund postage costs.
In the event that you change your mind about your purchase up to 24 hours before we have despatched your order, we will happily process your cancellation and issue you with a full refund. Simply contact us using the details below, at least 24 hours before your order is due for despatch and we will process your cancellation.
We also reserve the right to cancel your order in full or in part without explanation at any point prior to despatch, in which case we will advise you by email and issue a full refund to the value of the goods and shipping costs paid.
Note that all refunds given are made to the same payment source (payment card, cheque, cash etc) that was used when your purchase was made.
